YOUR FREEDOM. YOUR FUTURE.
San Diego Military DUI Defense Attorney
A DUI allegation can put both your freedom and military career at risk. Your defense needs to account for the criminal case, driving privileges, and the separate consequences of military service.

Location and status affect jurisdiction
An off-base DUI may be prosecuted in a California civilian court. Conduct on a military installation may involve federal jurisdiction, military proceedings for service members, or other arrangements depending on the property and legal authority. Location alone does not answer every jurisdictional question.
A civilian arrested on federal property is not automatically subject to military court-martial. The applicable federal statute or assimilated state law must be identified. National-park regulations are not a universal rule for every military-base incident.
Criminal and command consequences are different
A service member may face command or administrative action in addition to a civilian criminal case. Consequences can include restrictions on base driving, reprimands, treatment requirements, promotion or reenlistment issues, and separation proceedings. The available actions depend on the branch, record, and circumstances.
Neither discharge nor a particular punishment is automatic in every DUI case. Coordinate criminal-defense advice with qualified military defense counsel about reporting duties, interviews, command proceedings, and service-specific requirements.
Evidence and license issues still matter
The defense may examine the basis for the stop, evidence of driving, testing procedures, blood or breath reliability, and constitutional issues. A California DMV suspension or base driving restriction may need separate attention from the criminal charge.
Where available, military diversion or treatment-related alternatives require an eligibility review and are not guaranteed merely because someone serves or previously served. Counsel can assess the charge, service history, and applicable law.
