YOUR FREEDOM. YOUR FUTURE.
San Diego Military Criminal Defense Lawyer
For a service member, a criminal allegation can threaten far more than a court sentence. Protect your freedom, career, and benefits with advice that considers both military and civilian consequences.

Military and civilian systems can overlap
The Uniform Code of Military Justice governs covered service members separately from California criminal law. Conduct on or off base may lead to military action, civilian prosecution, or both, depending on jurisdiction, applicable law, and service policy. Location alone does not determine every jurisdictional question.
DUI, drugs, theft, assault, domestic violence, weapons, and sexual misconduct can create overlapping risks. Unauthorized absence, desertion, or disobedience of lawful orders involve additional military-specific provisions. Each charge requires its own factual and legal analysis.
Proceedings and your rights
Military matters can involve Article 15 nonjudicial punishment, administrative separation, or summary, special, or general courts-martial. An Article 32 preliminary hearing may precede a general court-martial, subject to applicable rules. Administrative proceedings and criminal trials are not interchangeable and carry different protections and consequences.
Service members have protections against self-incrimination, including Article 31 rights in covered questioning. The availability of assigned military counsel and the role of retained civilian counsel depend on the proceeding. Seek advice before an interview, waiver, or decision about accepting nonjudicial punishment.
Career and sentencing consequences
Depending on the offense and forum, consequences may include confinement, reduction in rank, forfeiture of pay, punitive discharge, or administrative separation. Security clearance, assignment, advancement, and benefits can also be affected. Not every discharge is equivalent to a felony conviction, and benefit eligibility requires separate review.
Counsel can examine witness accounts, digital and forensic evidence, consent where legally relevant, searches, and interrogation procedures. Negotiation and mitigation should account for both the court case and career effects without promising dismissal or retention in service.
