Bail and pretrial assessment in California
Pretrial release may involve bail, release on your own recognizance, supervision, or detention where legally authorized. California voters rejected Proposition 25 in 2020, so Senate Bill 10’s proposed statewide replacement of cash bail did not take effect. Older descriptions of an automatic statewide SB 10 risk-assessment schedule are not current rules.
Release decisions depend on current law, the charges, custody status, and applicable court procedures. Constitutional requirements include an individualized analysis rather than detention solely because someone cannot afford a financial condition. A lawyer should evaluate the actual order and local process.
What information may matter to the court?
Public and victim safety, the likelihood of appearing, the alleged conduct, prior record, and available alternatives may be relevant. Employment, housing, family support, treatment, and a history of attending court can help establish a workable plan. A risk label is not a replacement for individualized legal review.
Counsel can identify inaccurate background information, gather supporting documents, and propose lawful conditions. Do not assume that a particular charge always guarantees release or always requires detention; exceptions and legal standards need case-specific analysis.
Release conditions and later review
Conditions may include court appearances, no-contact orders, travel restrictions, monitoring, testing, or treatment when authorized and appropriate. Read the actual order carefully. Missing a hearing or violating a condition may lead to a warrant, revised conditions, or custody. Only the court can modify its order.
If circumstances change, counsel can assess whether a new hearing or modification request is appropriate. A release request does not decide guilt, and obtaining release is not a promise that the underlying case will be dismissed.
