YOUR FREEDOM. YOUR FUTURE.
San Diego Traffic Stop Defense Lawyer
A traffic stop can become a DUI, drug, weapons, or other criminal case. Get a review of why you were stopped, what officers did next, and whether the evidence was obtained lawfully.

The legal basis for a stop
Officers generally need a lawful basis to detain a driver, such as reasonable suspicion of a traffic violation or criminal conduct, subject to recognized exceptions like properly conducted checkpoints. Speeding, unsafe driving, or equipment issues can be relevant, but a stop’s legality depends on the actual facts and applicable law.
A lawful stop cannot be extended beyond its proper mission without an additional legal justification. Counsel can examine dash-camera footage, body-camera recordings, dispatch information, timing, and the officer’s stated reasons rather than rely solely on a report.
Your rights and practical steps
Pull over safely, keep your hands visible, and follow lawful instructions. Drivers generally must provide required license and vehicle documents. You can decline to answer potentially incriminating questions and clearly state that you do not consent to a search. Do not physically resist; officers may have another lawful search basis.
DUI testing has separate rules. After a lawful DUI arrest, implied-consent requirements and refusal consequences may apply. There is generally no right to delay required chemical testing until consulting an attorney. Preliminary roadside testing, age, probation, and the circumstances can change the analysis.
Searches, evidence, and defense options
A stop does not automatically authorize a full vehicle or phone search. Consent, probable cause, warrants, and recognized exceptions have limits. Defense issues can include an unlawful detention, an excessive extension, unreliable testing, mistaken identification, or insufficient proof of the charged offense. Suppression may be available where the legal requirements are met; dismissal is not automatic.
