YOUR FREEDOM. YOUR FUTURE.
San Diego Illegal Search and Seizure Lawyer
The discovery of evidence does not excuse an unlawful search. Get a careful review of the stop, warrant, and police conduct to understand whether evidence can be challenged.

Your Fourth Amendment protections
The Fourth Amendment protects against unreasonable searches and seizures by government officials. A challenge generally depends on your own protected privacy or property interest and the circumstances of the intrusion. These protections are not limited to U.S. citizens, and an arrest does not authorize an unlimited search of your home, belongings, or phone.
A warrant generally requires probable cause, judicial authorization, and adequate description of the place and items to be searched. Counsel can examine the affidavit, accuracy of supporting statements, scope, and execution. A signed warrant is not automatically beyond challenge.
Warrant exceptions have limits
Consent, exigent circumstances, certain vehicle searches, searches incident to arrest, and other recognized exceptions may permit a warrantless search. Each has limits. A protective frisk requires an appropriate basis to suspect a person is armed and dangerous; a traffic stop alone is not permission to search everything.
Plain view, border searches, probation or parole terms, and digital-device searches also have distinct requirements. Officers’ safety concerns or suspicion of evidence do not eliminate every constitutional safeguard. The exact sequence and location matter.
Challenging evidence through suppression
A motion under Penal Code section 1538.5 may seek suppression of evidence obtained in violation of search-and-seizure protections in a California criminal case. Deadlines, procedure, and exceptions to exclusion must be considered. Suppression can weaken the prosecution, but neither exclusion nor dismissal is automatic.
Preserve the details and get advice
Save the warrant, property receipt, recordings, and witness information. Do not physically resist a search; tell your lawyer what occurred. James N.
